Preamble
This Privacy Policy informs how the Guilbert Express company processes Users’ Personal Data in compliance with current regulations applicable to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (RGPD) and the French Data Protection Act (Loi “Informatique et libertés” n° 78-17 du 6 janvier 1978 modifiée).
Definition of terms used in the privacy policy
In the following, we will refer to :
- ” Customer “means any natural or legal person, consumer or professional, purchasing a Product(s) or Service(s) on the Site;
- ” Order “means any order for a Product or Service placed remotely via the Site;
- ” Customer Account “means the interface hosted on the Site enabling the User to track Orders, consult Material Safety Data Sheets and manage personal data;
- ” Conditions Générales de Vente “or ” GCS “means the contractual conditions governing the sale of Products to Customers by the Vendor via the Site;
- ” Terms and Conditions of Use “or ” GCU “means the general conditions of use governing all use of the Site and its functionalities by the User;
- ” Consumer “means, in accordance with the definition in the preliminary article of the French Consumer Code, “any natural person who acts for purposes that do not fall within the scope of his or her commercial, industrial, artisanal or liberal activity”;
- ” Data “means all types of information and/or data to which the Parties have access in the context of the contractual relationship, whatever the format or medium, whether Personal Data (defined below) or not (e.g. financial, technical, professional, administrative, commercial, legal, accounting data, etc.);
- “Personal data” is defined as ” any information relating to a natural person who is identified or can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to him or her “in accordance with the French Data Protection Act of January 6, 1978;
- “Publisher means the company Guilbert Express, a simplified joint stock company, responsible for the publication and content of the Site;
- ” Identifiers “means the e-mail address defined at registration and the password used to access the Customer Account. These Identifiers are for the exclusive use of the Member, who is solely responsible for them;
- ” Member “means the User registered on the Site and holding a Customer Account;
- ” Parties “means, individually and indiscriminately, the Publisher on the one hand and the Users on the other hand, or the Publisher and the Users collectively;
- ” Data subject “means all persons whose personal data is processed;
- ” product “shall designate all products that may be purchased on the Site;
- ” Data controller “means the person who determines the means and purposes of processing;
- ” Service “refers to all the services that can be subscribed to on the Site;
- “Site”: refers to the Internet site, grouping together all the web pages, Services and functionalities offered to Users, accessible at the following address: https://express.fr/ ;
- ” Subcontractor “means the person processing Personal Data on behalf of the Data Controller, acting under the authority of and on the instructions of the Data Controller;
- ” Processing” or “Process. “: means any of the operations referred to in Article 4 (2) of the RGPD, carried out on Personal Data in the context of the execution of this Privacy Policy ;
- “User or “You means any person accessing and browsing the Site. Users include Members, Customers and ordinary Internet users;
- “Vendor” means Guilbert Express, a simplified joint stock company, offering Products or Services on the Site ;
- ” Personal Data Breach “means a breach of security that results in the unauthorized access, destruction, loss, alteration or disclosure of Personal Data.
Article 1 – Role of the Privacy Policy
The purpose of this Privacy Policy is to inform you of Guilbert Express’s commitments with regard to the respect of your privacy and the protection of your Personal Data collected and processed during your use of the Site.
It is important that you read this privacy policy so that you are aware of why and how we use your data.
By registering on the Site, you agree to provide us with true information about yourself. Providing false information is contrary to the terms and conditions set out on the Site.

Article 2 – Data collected on the Site
The Data identified as mandatory on the Site’s forms are required in order to benefit from the Site’s corresponding functionalities, and more specifically from the operations on the content proposed within the Site.
The Data collected and subsequently processed by Guilbert Express is that which you voluntarily transmit to us by filling in the various forms on the Site.
For certain content-related operations, you may be required to transmit your personal data to third-party partners through their own services, more specifically when making payments. We will not have access to this data, as its collection and processing are governed by the terms and conditions specific to these parties. We invite you to consult their conditions before communicating your Data in this context.
In general, you can visit the https://express.fr/ website without providing any personal information about yourself. In all cases, you are under no obligation to provide this information. However, if you refuse, you may not be able to benefit from certain information or services.
We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregate data may be derived from your personal information, but is not covered as such by the law because it does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users who access a specific feature of the Site.
We do not collect “sensitive” data.
The detailed information provided below is not intended to be exhaustive and aims above all to inform Users of the categories of Personal Data that Guilbert Express is likely to process.

The Publisher’s collection of Users’ Personal Data does not require any declaration to the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL).
Article 3 – Identity of the data controller
The data controller is Guilbert Express, a simplified joint stock company with capital of 630,000.00 euros, registered in the Meaux Trade and Companies Register under number 572 055 812, whose registered office is located at ZAE de Lamirault – 10 rue Henry Delbast – F77183 Croissy-Beaubourg.

You may receive electronic mail from Guilbert Express, in particular as part of newsletters that you have accepted. You can ask to no longer receive these e-mails by contacting us at info@express.fr or by clicking on the link provided for this purpose in each e-mail sent to you.
Article 5 – Recipients and use of collected Data
Neither Guilbert Express nor its subcontractors market the personal data of visitors and users of its Site.
Your personal data may be shared with the parties listed below for the purposes set out in this privacy policy:
- Authorized Guilbert Express personnel who need to know this information in order to carry out their duties;
- External service providers (such as delivery services, data hosting, maintenance, etc.) who process your data on behalf of and according to the instructions of Guilbert Express ;
- The service providers responsible for payment management ;
- Authorized personnel of Guilbert Express subcontractors;
- Where applicable, the courts concerned, mediators, chartered accountants, auditors, lawyers, bailiffs, debt collection agencies, police or gendarmerie authorities in the event of theft or judicial requisition;
- Third parties who may place cookies on your terminals with your consent.
Certain categories of Subcontractors process Personal Data on behalf of Guilbert Express:
- The service provider in charge of the Site’s third-party application maintenance ;
- The Site host, if any ;
- The payment provider.

We require all third parties to guarantee the security of your personal data and to treat it in accordance with the law.
Article 6 – Data security
You are informed that your Data may be disclosed in application of a law, regulation or by virtue of a decision by a competent regulatory or judicial authority or, if necessary, in order for the Publisher to protect its rights and interests.
We have implemented appropriate security measures to prevent your personal data from being accidentally lost, used, modified, disclosed or accessed without authorization. In addition, access to your personal data is subject to a defined and documented security procedure.
Article 7 – Data retention period
The Data is stored by the Site’s host, whose contact details are given in the Site’s legal notice, and is kept for the time strictly necessary to achieve the aforementioned purposes.
After this period, they will be kept exclusively for statistical purposes and will not be used in any way whatsoever.

Article 8 – Authorized service providers and transfer to a non-EU country
Guilbert Express informs you that it has recourse to authorized service providers to facilitate the collection and processing of the data you have communicated to us. These service providers are located exclusively in the European Union.
Guilbert Express has previously ensured that its service providers implement adequate safeguards and comply with strict conditions in terms of confidentiality, usage and data protection. These service providers are also subject to the General Data Protection Regulation (RGPD).
Article 9 – Data-processing rights and freedoms
In accordance with legislation on the protection of personal data, you have the rights detailed below, which you may exercise as indicated in Article 1 of this Privacy Policy by writing to us at the postal address given above (ZAE de Lamirault – 10 rue Henry Delbast – F77183 Croissy-Beaubourg – France) or by sending an e-mail to dpo@express.fr :
- The right to information: we have an obligation to inform you about how we use your personal data (as described in this privacy policy).
- The right of access: this is your right to make a request for access to data concerning you in order to receive a copy of the personal data we hold; However, due to the obligation of security and confidentiality in the processing of personal data which is incumbent on Guilbert Express, you are informed that your request will be processed subject to you providing proof of your identity, in particular by producing a scan or photocopy of your valid identity document.
- The right to rectification, updating and completeness: the right to ask us to rectify any personal data concerning you that may be incomplete or inaccurate. Under this right, you are legally entitled to request the rectification, updating, blocking or deletion of data concerning you that may be inaccurate, erroneous, incomplete or obsolete.
- The right to erasure, also known as the “right to be forgotten”: in certain cases, you can ask us to delete the personal data we hold about you (unless there is a compelling legal reason for us to retain it).
- The right to restrict processing: in certain cases you have the right to ask us to suspend the processing of your personal data.
- The right to withdraw your consent at any time: you have the right to withdraw your consent whenever your consent is required for processing.
- The right to data portability: you have the right to ask us for a copy of your personal data in a common format (e.g. a .csv file).

You will not be charged for access to your personal data (or for exercising any other right). However, we may charge you a reasonable fee if your request is manifestly unfounded, repetitive or excessive. In this case, we may also refuse to respond to your request.
Guilbert Express will be entitled, if necessary, to oppose requests that are manifestly abusive due to their systematic, repetitive or numerous nature.
We may ask you for specific information in order to confirm your identity and to ensure your right of access to your personal data (or to exercise any other right). This is a security measure to ensure that your personal data is not given to anyone who is not authorized to receive it. We may also contact you to obtain more information about your request, in order to provide you with a faster response.
We try to respond to all legitimate requests within one month. This one-month period may be exceeded if your request is particularly complex or if you have made several requests. In this case, we will notify you and keep you informed.

If you consider that Guilbert Express is not complying with its obligations with regard to your Personal Information, you may lodge a complaint or a request with the competent authority.
